Terms of Service

1. Acceptance of these terms

These Terms of Service ("Terms") govern your use of tikconstruction.com (the "Site") operated by TIK Construction Inc. ("TIK", "we", "us", "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

These Terms govern Site use only. Restoration, mitigation, and reconstruction services are governed by separate written agreements signed before work begins. Nothing on the Site creates a service contract by itself.

2. Description of the Site

The Site provides information about TIK's services, service area, certifications, and ways to contact us. It is not the service itself. Submitting a form or calling us begins a conversation; it does not create a contractual obligation on either party until a written service agreement is executed.

3. Permitted and prohibited use

You may use the Site for lawful, personal, non-commercial purposes — including learning about TIK, requesting service, and reading our content. You may not:

• Scrape, harvest, or systematically extract content (including reviews, photos, or copy) without our written permission
• Use the Site to send spam, bot traffic, or fraudulent inquiries
• Reverse-engineer, copy, or republish the Site's design, code, or branding
• Attempt to gain unauthorized access to any part of the Site or its underlying systems
• Impersonate another person or misrepresent your identity in forms or calls
• Use automated tools to submit forms (we operate honeypot and rate-limit defenses; circumvention violates these Terms)

4. Intellectual property

The Site's content, design, brand identity, photographs of completed work, and the "TIK Construction" mark and logo are owned by TIK Construction Inc. or licensed to us. You may not copy, modify, distribute, sell, or create derivative works without prior written permission. Insurance carrier names and logos shown on the Site are trademarks of their respective owners and are used to identify carriers we work with on customer claims.

5. Reviews and customer content

Reviews shown on the Site are real reviews left by customers on Google. We do not paraphrase, edit, or remove reviews to make ourselves look better. We pull reviews directly and present them with the customer's name as posted publicly. If you are a customer who would like a review removed (e.g., it was posted in error or contains private information), contact us and we will work with you to address it.

6. Third-party links and content

The Site may link to third-party websites (Google Maps, our Google Business Profile, insurance carrier sites, etc.). We are not responsible for the content, privacy practices, or terms of those sites. Visiting them is at your own risk and subject to their terms.

7. Disclaimers

The Site and its content are provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Information about restoration timelines, costs, insurance coverage, and similar topics is general and may not apply to your specific situation. Actual restoration work is always governed by a written service agreement and your insurance policy where applicable.

We make no warranty that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Phone numbers shown on the Site are answered 24/7 under normal operating conditions, but we cannot guarantee uninterrupted phone service due to factors outside our control (carrier outages, natural disasters, etc.).

8. Limitation of liability

To the fullest extent permitted by law, TIK Construction Inc. and its officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, including loss of data, loss of profits, or business interruption — even if we were advised of the possibility of such damages. Our total liability for any claim arising from Site use is limited to one hundred U.S. dollars ($100).

This limitation applies to Site use only. It does not limit our liability for restoration services provided under separate written service agreements, nor does it limit liability for fraud, willful misconduct, or any liability that cannot be excluded under applicable law.

9. Indemnification

You agree to indemnify and hold TIK Construction Inc. harmless from any claim, demand, loss, or damage (including reasonable attorneys' fees) arising from your misuse of the Site, your violation of these Terms, or your violation of any third-party right.

10. Modifications to these terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. Material changes will be flagged on the homepage for at least 30 days. Continued use of the Site after the effective date of changes constitutes acceptance.

11. Governing law and disputes

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-laws principles. Any dispute arising from or relating to the Site will be resolved exclusively in the state or federal courts located in Clark County, Washington, and you consent to the personal jurisdiction of those courts.

12. Severability and entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and TIK regarding Site use.
